In my experience as a military commander and later as Assistant Secretary of Defense, I saw first-hand the great job being done by the vast majority of U.S. businesses as the supported their employees who were members of the National Guard or Reserves. Most business leaders made tremendous efforts to fully comply with the requirements of the Uniformed Services Employment and Reemployment Rights Act (USERRA) despite the fact that compliance is not always easy. The same can be said for the Servicemembers Civil Relief Act (SCRA.)

Non-compliance with these statutes can be costly, both in terms of money judgments and damage to a firm’s reputation. USERRA has been described as one of the most far-reaching employee protection statutes ever enacted, so a company’s failure to appreciate the full scope of those protections is understandable.  Unfortunately, failure to understand is not a defense.

Even where upper management is committed to full compliance, someone making up a work schedule may intentionally or unintentionally take an action that violates USERRA.
